GENERAL TERMS
FOR USING THE SERVICES PROVIDED

I. GENERAL PROVISIONS
1. This document contains the General Terms and Conditions according to which "Profi Sound" Ltd. provides services to its users/clients through the online store www.music-center.bg. These terms are binding on all users. By placing an order on one of the phones listed in the "Contacts" field or pressing the "I agree with the General Terms and Conditions" button, the user/client agrees, fully accepts and undertakes to comply with these general terms and conditions.
2. The products found on the website of www.music-center.bg do not constitute a legally binding offer with prices and availability, they are a demonstrative online catalog describing the merchant's product line.
3. The images and descriptions of the products found on the website of www.music-center.bg are informative and illustrative in nature and do not claim to be accurate or comprehensive. The inaccuracy of the images, as well as their absence, cannot be interpreted as misleading information/advertising and are not intended to mislead consumers or give the products non-existent technical characteristics or capabilities. Most of the product images show the top model of a series or an entire series to which the product belongs. In the images of the products, they may be shown together with their optional accessories that are not included in the price or together with other products for which they are intended. The images of the products also do not carry information about color (unless this is explicitly mentioned), quantity, technical characteristics and capabilities. Product descriptions may be incomplete, inaccurate, or changed by the manufacturer during the manufacturing process of a product. The manufacturers and "Profi Sound" Ltd. have the right to change prices, availability of products or their technical characteristics at any time, without being obliged to explicitly notify users of this.
4. After registration, users have the opportunity to use a shopping cart, which was created for the purpose of convenience and easy calculation and accessibility of the user/customer to the characteristics of the goods they are interested in. Placing the products in the shopping cart has no binding effect. The user/customer has the possibility to put and remove different products in his shopping cart.
By clicking the "Send order" button, users agree to purchase the goods in the shopping cart at the price current at that time. Only orders that are confirmed after a telephone conversation by an employee of "Profi Sound" Ltd. with a given user the order are considered finalized and ready to be sent.
5. "Profi Sound" Ltd. reserves the right to refuse delivery of an order in case that the goods are not available or the price is not current at the time of dispatch, regardless of the reason - program error, hacker attack, technical error by employee of Profi Sound" Ltd., etc. If there is no stock of the requested product, within one working week, "Profi Sound" Ltd. notifies the user/client of the depletion of the goods by sending a message to the e-mail address specified by the user/client or to the specified telephone number. In case a transfer is made to the merchant's account, the customer will be able to choose between the following options:
-refunds;
-cancellation of the order;
-substitute order;
-waiting for new delivery
6. The contract languages are Bulgarian or English, and the prices announced on the site are in Bulgarian levs with VAT included and do not include delivery, unless it is free.
II. DELIVERY
7. The delivery of the goods takes 24 hours to 2 weeks, and the customer is notified in advance of the period. The delivery of the goods is carried out personally by the team of "Profi Sound Ltd." or by the courier company "EKONT", and then the general conditions announced by the courier are in force. Free shipping only applies to goods that are not on sale, liquidation or with a special price! Free delivery is available for goods with a total value of over BGN 50. Free delivery does not apply to goods sent to an address, only those sent to the office of the courier company.
7a. The user/customer bears the entire risk of damage/loss of the goods during delivery. Immediately after handing over the goods to the courier, "Profi Sound" Ltd. is released from the risk, which is transferred to the user/client. "Profi Sound" Ltd. is not responsible for any delay in case that the delay is due to a courier or other supplier.
8. Immediately after delivery, the goods should be carefully inspected by the user/customer or an authorized person. In case the goods are delivered by courier, the user/customer should notify the trader of the discrepancy with the contract no later than 12 hours after receipt. When the customer receives the product himself, he is given a technical opportunity to test the product and, if any discrepancies are found, he should immediately notify a representative of "Profi Sound" Ltd.
9. Any damages, impacts and other damages must be certified on the bill of lading and reported within 12 hours to "Profi Sound" Ltd. In case damage is found during the transportation of the goods, "Profi Sound" Ltd. is not responsible for the warranty service of this product.
10. In case "Profi Sound" Ltd. has set a specific date and time for delivery the statement is binding. The user/customer is obliged to provide the trader with the necessary information for the delivery by specifying an exact address, contact person and telephone number in the request, as well as to enter or explicitly notify him of a suitable time /date and time/ in which he will be able to accept/receive the goods. "Profi Sound" Ltd. is not bound by any obligation to fulfill the order and delivery in cases where the user/client has indicated an incorrect or incorrect address, contact person and/or phone number when submitting the request. In case of non-fulfilment of the obligations specified in this provision, the user/client undertakes to indemnify the merchant for all incurred additional costs related to the storage and subsequent delivery of the goods, as well as the impossibility of delivery.
10a. Upon delivery of the goods to the consumer/customer or to the third party, the parties sign the accompanying documents. A third party is anyone who is not the holder of the application, but accepts the goods and is located at the address specified by the customer.
In case of unjustified refusal of the goods, the user/customer shall pay the costs of delivery and return of the goods. In the event that the Customer is not found within the deadline for delivery to the specified address or access to the address and conditions for delivery of the goods are not provided within this deadline, "Profi Sound" Ltd. is released from its obligation to deliver the goods requested for purchase. In this case, the customer has the obligation to organize the delivery of the goods himself, without releasing himself from his obligations for compensation under the previous article.
11. When the delivered goods clearly do not correspond to the Customer's purchase requests for goods and this can be established by a simple inspection, the customer may request that the delivered goods be replaced with those corresponding to the purchase request made by him. This request should be made no later than 12 hours after receiving the goods.
III. WARRANTY PERIOD, LEGAL WARRANTY
12. All goods presented on the site and/or sold in the online store have a legal warranty for compliance of the goods with the contract of sale according to article 112-115 of the Consumer Protection Act. The commercial warranty does not affect the rights of consumers arising from the warranty under article 112-115, from the Consumer Protection Act. Regardless of the commercial warranty, the seller is responsible for the non-compliance of the consumer goods with the sales contract according to the warranty under article 112-115 of the Consumer Protection Act. "Profi Sound" Ltd. offers a warranty document, a legal warranty for compliance of the goods with the contract of sale, to its customers for a given purchased goods, in cases where such a document is provided by the manufacturer of the goods.
The warranty document describes: address and phone number of the authorized service centers of the purchased product, the warranty conditions of the service centers or manufacturers, as well as the warranty period of the product purchased by the user/customer. Together with the goods, "Profi Sound" Ltd. provides its customers with a warranty document, in accordance with the requirements of the Consumer Protection Act, in which the warranty conditions are described /hyperlink pointing to the page where the warranty conditions are described/.
The user/customer is obliged to transport/deliver the defective product to the address of the authorized service center at his own expense.
IV. PRICES AND PAYMENT
13. All announced prices include VAT. The prices indicated on the site include packaging, but not transportation to the place of delivery, as well as the payment fee - the transfer of funds from the client to "Profi Sound Ltd.". In case the goods are sent outside the territory of the Republic of Bulgaria, the user/customer should pay all customs fees related to the export and import in the respective country. The price of the transport costs, when they are at the customer's expense, are determined by a courier service price calculator in the "Information / Deliveries" field.
14. Payment is made as follows:
-By cash on delivery;
-Payment on the spot;
-By bank transfer;
V. RIGHTS AND OBLIGATIONS OF THE USER/CLIENT
15. The user/client has the opportunity to see and order the advertised goods on the www.music-center.bg Internet store
15a. According to article 55. (1) of the Consumer Protection Act, the consumer/customer has the right, without owing compensation or penalty and without stating a reason, to withdraw from the concluded contract remotely within 14 working days from the date of receipt of the goods by returning them to the merchant at his own expense, packed in intact original packaging and commercial appearance, without visible signs of use and complete with all accompanying accessories and documents and accompanied by a printed and duly completed Form.
The provisions of article 50 - 56 of the Consumer Protection Act on the consumer's right of withdrawal from the contract remotely or outside the commercial premises do not apply to contracts for the supply of sealed goods that are unsealed after their delivery and cannot be returned due to reasons related to hygiene or health protection such as in-ear headphones, vocal microphones, boards, mouthpieces for wind instruments, harmonicas and other wind instruments without a separate mouthpiece, mouth controllers, etc.
15b. When returning the product the user/customer has the right to choose another product at the same price or higher by paying the difference, or to request a refund by providing their bank account to which the amount will be refunded in period of 30 days from the date of return of the product.
15c. The refund is made within the period mentioned in the previous paragraph to a bank account whose owner is the same person in whose name the invoice for the purchase was issued.
16. The user/customer has the right to be informed about the status of his order.
17. The user/client bears full responsibility for the protection of his username and password, as well as for all actions that are carried out by him or a third party using the username and password. The user is obliged to immediately notify "Profi Sound" Ltd. of any case of unauthorized access by using his username and password, as well as whenever there is a danger of such use.
18. The user/customer is obliged to pay the price of his order according to the method chosen by him when placing the order.
19. The user/client is obliged to provide "Profi Sound" Ltd. with the necessary information for the delivery by specifying an exact address, contact person and phone number when making the request, as well as to enter or explicitly notify him of a suitable time /date and time/, in which he will be able to accept/receive the goods.
20. Every user, regardless of whether he is a client of "Profi Sound" Ltd., undertakes when using the services:
-not to violate and respect the fundamental rights and freedoms of citizens and human rights, according to the Constitution and laws of the Republic of Bulgaria and recognized international acts;
-not to harm the good name of another and not to call for a violent change of the constitutionally established order, to commit a crime, to violence against the person or to incite racial, national, ethnic or religious enmity;
-not to violate others' property or non-property, absolute or relative rights and interests, such as property rights, intellectual property rights, etc.;
-to comply with Bulgarian legislation, applicable foreign laws, rules of morality and good manners and Internet ethics when using the services provided by "Profi Sound" Ltd.;
-to immediately notify "Profi Sound" Ltd. of any case of committed or detected violation when using the provided services;
-not to upload, send, transmit, distribute or use in any way and not to make available to third parties software, computer programs, files, applications or other materials containing computer viruses, unauthorized remote control systems ("Trojan horses "), computer codes, or materials designed to interrupt, hinder, disrupt, or limit the normal operation of computer hardware or software or telecommunications facilities, or aimed at unauthorized penetration or access to foreign resources or software;
-not to commit malicious acts;
-to compensate "Profi Sound" Ltd. and all third parties for all damages suffered and lost benefits, including any costs and paid attorney's fees, incurred as a result of claims made by and/or compensation paid to third parties in connection with Internet pages, hyper- links, materials or information that the User has used, placed on the server, sent, distributed, disclosed to third parties or made available through www.music-center.bg in violation of the law, these General Terms and Conditions, Good manners or Internet ethics;
21. The customer undertakes to pay the price of the goods, to pay the costs of the delivery, when the delivery is not free and to ensure access to the place of delivery, as well as to ensure recieving of the goods, to pay the costs of the delivery and for the return to the warehouse of Profi Sound Ltd. in case that he refuses to receive the goods on the day of delivery.
VI. RIGHTS AND OBLIGATIONS OF PROFI SOUND Ltd.
22. "Profi Sound" Ltd. does not have the obligation and possibility to control the way users use the services provided.
23. "Profi Sound" Ltd. has the right but not the obligation to save materials and information located on the server of http://music-center.bg/
24. "Profi Sound" Ltd. has the right to terminate, suspend or change the services provided in connection with the use of the website at any time regardless of whether the user violates the rules or at its discretion.
"Profi Sound" Ltd. is not responsible to users and third parties for damages and lost benefits, which occurred as a result of the termination, suspension, change or limitation of services, deletion, modification, loss, unreliability, inaccuracy, or incompleteness of messages, materials or information transferred, used, recorded or made available through www.music-center.bg.
25. After receiving the payment "Profi Sound" Ltd. undertakes to transfer to the user/customer the ownership of the goods requested by him, to deliver the goods requested for purchase on time, to check the technical condition of each item before it is sent (in case , that this is possible without breaking the integrity of the package).
26. "Profi Sound" Ltd. is not responsible for damages caused by software, hardware or telecommunications equipment, or for loss of data from materials or resources searched, loaded or used in any way through the services provided. The advice, consultations or assistance provided by the specialists and employees of "Profi Sound" Ltd. in connection with the use of the services by the users does not bind "Profi Sound" Ltd. with any responsibility or obligations. The company is not responsible if the information provided by the manufacturer about the product is incorrect.
27. "Profi Sound" Ltd. is not responsible for non-fulfilment of its obligations under this contract in case of circumstances that "Profi Sound" Ltd. did not foresee and was not obliged to foresee - including cases of accidental events, problems in the global network of the Internet and in the provision of services beyond the control of "Profi Sound" Ltd.
28. "Profi Sound" EOOD has the right to install cookies on users' computers. Cookies are text files that are saved by the Internet page on the User's hard disk and allow the recovery of information about the User, identifying him and allowing the tracking of his actions, the Internet pages he visits, the hyperlinks he uses, the information that uses and records and so on.
VII. PERSONAL DATA
29. The identification of the user/client in order to reproduce his/her statement of acceptance of the General Terms and Conditions as well as of the order made, is carried out through the log files stored on the server of www.music-center.bg, storage of the IP address of the user/customer as well as any other information.
30. "Profi Sound" Ltd. guarantees its Users/clients the confidentiality of the provided information and personal data. The information and personal data will not be used, provided or brought to the knowledge of third parties except in the cases and under the conditions specified in these General Terms and Conditions. "Profi Sound" Ltd. protects the personal data of the user/client, and this obligation is waived in case that the Client has provided incorrect data. In compliance with current legislation and the clauses of these General Terms and Conditions, it may use the Customer's personal data solely and exclusively for the purposes provided for in the contract. Any other purposes for which the data is used will be in accordance with Bulgarian legislation, applicable international acts, Internet ethics, rules of morality and good manners.
31. "Profi Sound" EOOD undertakes not to disclose any personal data about the Client to third parties - state authorities, commercial companies, individuals and others, except in cases where it has received the express written consent of the Client, the information is requested by state authorities or officials authorized by applicable law to request and collect such information. "Profi Sound" EOOD is obliged to provide the information under the law.
32. "Profi Sound" EOOD has the right to collect and use information relating to its Users/clients, regardless of whether they are registered.
VIII. CHANGES
34. The general conditions may be changed at any time by "Profi Sound" Ltd.
"Profi Sound" EOOD has the right to change the characteristics of the services provided and these General Terms and Conditions and on the basis of changes in the legislation. "Profi Sound" Ltd. has the right to collect and use information relating to its Users/clients, regardless of whether they are registered.
"Profi Sound" Ltd. has the right to immediately suspend or terminate the provision of services to the User.
IX. TERMINOLOGY
35. "User/client" means anyone who has loaded the www.music-center.bg website on their computer.
36. "Order" means the selected goods and all other attributes related to the method of delivery and payment of the goods by the customer/user.
37. Place of delivery is the address specified by the user/customer when placing the order.
38. The online store www.music-center.bg is owned by "Profi Sound" Ltd. and has the right to collect and use information relating to its Users/clients, regardless of whether they are registered.
39. All disputes between the parties shall be resolved in a spirit of understanding and goodwill. In the event that no agreement is reached, all unresolved disputes, including disputes arising out of or relating to its interpretation, invalidity, performance or termination, as well as disputes to fill gaps in the contract or adapt it to new circumstances, will be resolved by the competent court for registration of "Profi Sound" Ltd. has the right to collect and use information relating to its Users/clients, regardless of whether they are registered.
